By submitting an order, you agree to these terms and to the product, price, fulfillment, cancellation, and other details shown at checkout. If an order confirmation contains different order-specific terms, the confirmation controls for that order.

Nothing in these terms limits rights that cannot be waived under applicable law.

Tabu Cookie Co. operates as a Florida Cottage Food Operation. Our products are prepared in a home kitchen that is not subject to Florida’s food safety regulations.

Products are offered and sold in accordance with applicable Florida cottage food laws. Product availability, pickup and delivery options, and shipping destinations may be limited by those laws.

Please read the product label and any required cottage food disclosure provided with your order. Product descriptions and photographs are intended to represent our products, but because every item is handmade in small batches, reasonable variations in size, weight, color, decoration, texture, and overall appearance are normal and are not considered defects.

Products are intended for the end customer and may not be resold without the prior written consent of Tabu Cookie Co. and only where permitted by applicable law.

Ingredient and major allergen information is provided on each product label as required by applicable law.

Our products are prepared in a home kitchen that also processes common allergens, including wheat, milk, eggs, soy, peanuts, and tree nuts. While we take reasonable precautions to reduce the risk of cross-contact, we cannot guarantee that any product is free from allergens.

Products described as gluten-friendly are made with gluten-free ingredients but are prepared in a kitchen where wheat is also used. As a result, they are not recommended for individuals with celiac disease or anyone who must avoid gluten due to a medically diagnosed gluten-related disorder.

If you have a food allergy, intolerance, or other dietary restriction, please review the available ingredient information and contact Tabu Cookie Co. before placing your order. You are responsible for determining whether a product is appropriate for you or the intended recipient. Orders are subject to acceptance by Tabu Cookie Co. An order is considered accepted once payment has been successfully processed and an order confirmation has been issued.

All products are offered while supplies last and are subject to ingredient availability, production capacity, and scheduling. Because our products are handmade in small batches, quantities may be limited.

Tabu Cookie Co. reserves the right to refuse, cancel, or limit any order due to pricing or website errors, unavailable ingredients, production limitations, suspected fraud, suspected misuse of promotions, an unsafe or unlawful request, or any other circumstance that prevents us from fulfilling the order as intended.

If we cancel all or part of a paid order before fulfillment, you will receive a refund for the canceled portion of your order.

All prices are listed in U.S. dollars and are subject to change without notice until an order has been placed.

The total amount due, including applicable taxes, delivery or shipping fees, discounts, and any other charges, will be displayed at checkout before your order is submitted.

Payment in full is required at the time an order is placed. Orders are not confirmed until payment has been successfully processed and an order confirmation has been issued.

Payments are securely processed through the payment provider displayed at checkout. By submitting your order, you authorize the payment provider to charge your selected payment method for the total amount shown at checkout.

Custom orders are not available for purchase through this website. If you are interested in a custom order or special request, please contact Tabu Cookie Co. before placing an order to discuss availability, pricing, and scheduling.

Once an order has been placed, it cannot be changed or canceled because our products are made fresh to order and production begins shortly after an order is received.

If you receive an incorrect order or a product that is significantly damaged or appears unsafe to consume due to an error on our part, please do not consume the affected item. Contact Tabu Cookie Co. within 24 hours of pickup, delivery, or receipt of your shipment using the contact information provided in your order confirmation. We will review the issue and, when appropriate, provide a replacement, store credit, or refund at our sole discretion.

Available fulfillment methods, pickup locations, delivery areas, available time windows, fees, and shipping options are shown during checkout and in your order confirmation.

Local Pickup: Pickup is available only during the location and time selected at checkout. Pickup locations and availability may vary each week based on our baking schedule and market events. If you are unable to arrive during your selected pickup window, please contact us as soon as possible to discuss alternative arrangements.

Local Delivery: Delivery is available to eligible areas shown at checkout. Please ensure the delivery address is accurate and that someone is available to receive your order, or provide a safe location for delivery if requested. Once an order has been delivered to the address provided, responsibility for the order transfers to the customer.

Florida Shipping: We currently ship only within the state of Florida. To ensure your cookies are baked fresh and to help avoid weekend carrier delays, orders placed by 11:59 PM ET each Thursday will ship on the following Monday. Orders placed after the Thursday cutoff will ship on the next scheduled shipping Monday.

Shipping dates are estimates and may be affected by weather, carrier delays, holidays, or other circumstances beyond our reasonable control. While every order is carefully packaged, minor cosmetic changes during transit, including smudged chocolate drizzle, shifted toppings, or slight movement of fillings, may occur and are considered normal.

Customers are responsible for providing accurate pickup, delivery, and shipping information and for following any storage and food safety instructions after receiving their order.

If Tabu Cookie Co offers a subscription, the frequency, products or benefits, recurring price, pickup or delivery method, and any minimum term will be shown before purchase. By subscribing, you authorize recurring charges until cancellation.

You may cancel future renewals using the account or contact method provided with the subscription. Cancellation does not automatically refund a charge already processed or an order already prepared, except when required by law or stated in the subscription offer.

If you create an account, you are responsible for keeping your sign-in information secure and for activity under the account. Contact the business if you believe the account has been used without permission.

You agree to receive electronic order records and transactional communications at the contact information you provide. Marketing email or text messages require the consent described when you sign up and can be stopped using the unsubscribe or opt-out instructions in the message.

Tabu Cookie Co is responsible for products and remedies to the extent required by applicable law. To the fullest extent the law permits, Tabu Cookie Co is not responsible for losses caused by inaccurate customer instructions, failure to collect or receive an order, improper handling after fulfillment, unauthorized resale, or events outside reasonable control.

If you have a concern, contact Tabu Cookie Co promptly using the information on this website or in your order confirmation so the parties can try to resolve it. These terms are governed by the laws that apply to the sale. If one provision cannot be enforced, the remaining provisions continue to apply.

Because our cookies and baked goods are made fresh to order and are perishable food items, all sales are final. We do not accept returns, exchanges, or cancellations once an order has been placed.

If we are unable to fulfill your order due to circumstances within our control, you will receive either a full refund or the option to reschedule your order.

Handmade baked goods naturally vary from batch to batch. Slight differences in size, weight, shape, color, texture, and decoration are normal and are not considered defects.

For shipped orders, minor cosmetic changes that occur during transit, including smudged chocolate drizzle, shifted toppings, cracked decorations, or slight movement of fillings, are considered normal and do not affect the quality, freshness, or safety of the product. Because these products remain fully edible, cosmetic changes are not eligible for a refund, replacement, or exchange.

If your order arrives with significant damage that makes the product inedible or if you receive the wrong item due to an error on our part, please contact us within 24 hours of pickup, delivery, or receipt of your shipment. Include your order number and clear photos of the product and packaging, if applicable. We will review the issue and, if appropriate, provide a replacement, store credit, or refund at our sole discretion.

Tabu Cookie Co. is not responsible for issues resulting from:

• Incorrect pickup, delivery, or shipping information provided by the customer.

• Failure to pick up an order during the scheduled pickup window without prior arrangements.

• Improper storage or handling after an order has been picked up, delivered, or received.

• Shipping delays, carrier mishandling, weather conditions, or other circumstances beyond our reasonable control that do not render the product inedible.

If pickup, delivery, or a scheduled market event must be changed due to severe weather or other unforeseen circumstances, we will contact you using the information provided with your order to arrange an alternative pickup or delivery whenever reasonably possible.
